Made-to-Order Policy

1. Nature of Our Products
Every gown, dress, and garment sold by Netta BenShabu Elite Couture LLC (“we,” “us,” “our”) is a made-to-order, handcrafted item. Nothing is held in pre-made inventory. When you place an order, you are commissioning a garment that does not yet exist and that we begin constructing specifically for you, using your selections (size, color, customizations, and any other options chosen at checkout).
By placing an order, you acknowledge and agree that:
- Production begins shortly after your order is confirmed and payment is authorized, using materials (fabric, lace, beading, trims) that are cut, sourced, or committed specifically to fulfill your order.
- Because production is initiated immediately and materials cannot be resold or reused for another customer once cut or embellished, made-to-order items carry a fundamentally different cost and risk structure than off-the-rack retail goods.
- This policy governs the transaction in place of a standard retail return policy, and you are agreeing to these terms—not a general retail return standard—at the time of purchase.
2. Final Sale — No Cancellations, Returns, Exchanges, or Refunds
All made-to-order purchases are final. Once an order is placed and payment is processed:
- No cancellations will be accepted, for any reason, at any stage of production, including before production has visibly begun.
- No returns will be accepted.
- No exchanges (for a different size, color, style, or otherwise) will be accepted.
- No refunds, in whole or in part, will be issued, including for buyer’s remorse, change of mind, delayed shipping, mismatched expectations about fit or appearance, or any other reason not expressly provided for in Section 7 below.
This policy applies regardless of the payment method used, including credit card, debit card, buy-now-pay-later services, or third-party payment processors.
3. Order Confirmation and Your Acknowledgment
At checkout, you are required to affirmatively acknowledge this Made-to-Order Policy before your order can be submitted. Your acknowledgment, combined with your voluntary submission of payment information and completion of the purchase, constitutes:
- Your express authorization for us to charge the payment method provided for the full order amount;
- Your informed, affirmative consent to a custom-manufacturing transaction governed by this policy, in lieu of a standard retail sale;
- Your representation that you have read, understood, and accept the terms in this policy, including the final-sale nature of the purchase.
We recommend retaining a copy of your order confirmation email, this policy, and any correspondence with our team, as this may serve as evidence of the terms you agreed to.
4. Sizing and Measurements
Because each garment is cut and constructed to the size specifications you select, you are solely responsible for reviewing our size chart and selecting the correct size before completing your order.
- Our size guide, measurement instructions, and (where applicable) custom measurement forms are available on our website and are provided so that you can make an informed selection.
- Our team is available prior to purchase to answer sizing questions, help you select a size, or advise on fit—we encourage you to reach out before ordering if you have any uncertainty.
- We are not responsible for sizing errors resulting from measurements you provided, standard sizing selections you made, or garments that do not fit due to changes in your body after the order was placed.
- Standard body measurement variance and industry-standard garment construction tolerances (commonly +/- 0.5″–1″, depending on the garment and technique) are normal in handmade construction and do not constitute a defect.
5. Handmade Variations
Each item is made by hand, and hand-applied embellishment (including but not limited to beading, lace appliqué, embroidery, and fringe) is inherently variable. You acknowledge and accept that:
- Minor variations in beading density, placement, embroidery pattern positioning, fringe length, color shading (including dye-lot variation in lace, thread, and trims), and overall finish are expected characteristics of handmade goods and are not considered defects.
- Photos shown on our website are representative but may differ slightly from the finished garment due to lighting, screen calibration, and the handmade nature of each piece.
- These natural variations do not qualify as grounds for a return, exchange, refund, or chargeback dispute.
6. Production and Delivery Timelines
- Estimated production timelines are provided at the time of order and on our website, and are approximate, not guaranteed delivery dates, unless a specific delivery date was expressly confirmed in writing by our team.
- Delays caused by circumstances outside our reasonable control (see Section 9, Force Majeure) do not entitle you to a cancellation, refund, or chargeback.
- If your timeline is inflexible (e.g., a wedding or event date), it is your responsibility to confirm feasibility with our team in writing before placing your order. We are not responsible for missed events due to shipping carrier delays once a garment has left our facility in the timeframe we quoted.
7. Limited Exceptions
The only circumstances under which we will consider a remedy (which may include repair, store credit, or, at our sole discretion, a partial or full refund) are:
- Manufacturing defect: The garment arrives with a genuine defect in workmanship (e.g., a structural seam failure, not natural handmade variation as described in Section 5) that was not disclosed prior to purchase.
- Materially different from order: The garment received is a fundamentally different item than what you ordered (e.g., wrong style entirely), not a minor variation in shade, embellishment placement, or fit.
- Carrier loss or damage in transit: The item is lost or arrives damaged due to shipping carrier mishandling (subject to our Shipping Policy and any applicable carrier claims process).
To be considered under this section, you must notify us in writing at shop@maisondenetta.com within 3 days of delivery, including your order number, a description of the issue, and clear photographs/video. Claims submitted after this window, or without sufficient documentation, will not be eligible for review. Any remedy under this section is at our sole discretion and does not obligate us to provide the same remedy in future or unrelated situations.
8. Chargebacks and Payment Disputes
We take payment disputes seriously and ask that you contact us directly at shop@maisondenetta.com before initiating a chargeback or dispute with your bank or card issuer. Most concerns can be resolved faster and more effectively through direct communication with our team than through a bank dispute process.
By placing an order, you acknowledge that:
- You have read and agreed to this Made-to-Order Policy, and your purchase reflects informed consent to a custom-order, final-sale transaction—not a standard retail purchase with an implied right of return.
- Filing a chargeback for a garment that was accurately produced to your specifications, delivered, and matches your order (including the natural handmade variations described in Section 5) is not a valid basis for an “item not as described” or “unauthorized transaction” dispute, and we will contest such disputes with your card issuer using your order confirmation, this policy, your acknowledgment at checkout, production records, and delivery/tracking confirmation as evidence.
- Nothing in this policy is intended to, nor does it, waive or limit any right you may have under applicable law to dispute a charge that was genuinely unauthorized, fraudulent, or for non-delivery of goods. This section addresses disputes over garments that were properly authorized, made-to-order, and delivered as described.
- We maintain records of order details, size/customization selections, in-progress production documentation, and shipment tracking for every order, which may be submitted as evidence in any payment dispute.
9. Force Majeure
Netta BenShabu Elite Couture LLC shall not be held liable for any failure or delay in performance or delivery resulting from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of war, civil unrest, terrorism, governmental actions or restrictions, labor disputes, pandemics, epidemics, transportation disruptions, or other force majeure events. In such cases, production timelines may be adjusted without penalty or liability. Such events do not entitle you to a cancellation, refund, or chargeback under this policy.
10. Limitation of Liability
To the fullest extent permitted by law, our total liability arising out of or relating to your order—whether in contract, tort, or otherwise—is limited to the amount you paid for the applicable item. We are not liable for indirect, incidental, consequential, or special damages, including but not limited to loss of use, lost time, or emotional distress related to event planning, even if we have been advised of the possibility of such damages. Nothing in this section limits liability that cannot be limited under applicable law.
11. Assumption of Risk / Acknowledgment of Terms
By completing checkout, you affirmatively represent that:
- You have reviewed our sizing information, product photos, and description prior to ordering, and/or consulted with our team regarding sizing or fit;
- You understand this is a custom, made-to-order garment and not a stock retail item;
- You accept that the purchase is final sale, non-cancellable, non-returnable, and non-refundable except as expressly stated in Section 7; and
- You agree to resolve any concerns directly with us prior to pursuing a payment dispute, per Section 8.
12. Governing Law and Dispute Resolution
This policy, together with our Terms of Service and Privacy Policy, constitutes the agreement between you and Netta BenShabu Elite Couture LLC regarding made-to-order purchases. This policy is governed by the laws of the State of California, without regard to conflict-of-law principles, and any dispute arising out of or relating to this policy or your purchase shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles, California, unless otherwise required by applicable consumer protection law in your jurisdiction.
13. Severability
If any provision of this policy is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that this policy will otherwise remain in full force and effect.
